FREQUENTLY ASKED QUESTIONS AND ANSWER SHEET

QUESTION: What are my voting rights in the condominium association?
Answer: Each unit owner is entitled to one (1) equally-weighted vote for per unit. (See Article 11 of the Declaration of Condominium, Article IX of the Articles of Incorporation and Article II of the Bylaws.)
QUESTION: What restrictions exist in the condominium documents on my right to use my unit?
Answer: Units are to be used for residential purposes only. Occupancy is limited to two (2) people per bedroom in each unit. There shall not be any activity that would obstruct the common elements. Any activity that increases the insurance rate on or within the condominium or common elements is prohibited. Any noxious, destructive or offensive activity shall not be conducted on or within the condominium or common elements.

  • No more than two (2) generally-recognized household pets may be kept in any portion of the Condominium.
  • The act of swimming or fishing in the common area pond is prohibited.
  • The use of outdoor grills in the common areas or within the Condominium is strictly prohibited.
  • The use of the fireplace within the Condominium is strictly prohibited. The fireplaces are currently for decorative purposes only.
  • The replacement of flooring within the condominium unit is subject to approval by the Architectural Review committee. (See Article 23 of the Declaration of Condominium and any of the Associations Rules and Regulations.)

QUESTION: What restrictions exist in the condominium documents on the leasing of my unit?
Answer: Any and all lease agreements shall be in writing and approved by the Board of Directors prior to the effective date of the lease agreement. Any and all lease agreements shall be for a minimum term of nine (9) months.
When a unit is leased, the tenant shall have all use rights of the association property and common elements that otherwise would be available for use by a unit owner. Clubhouse rental is only available to tenants through explicit written permission from the unit owner. In the event that the Clubhouse is damaged or misused, the unit owner shall be responsible for the tenant’s actions.
QUESTION: How much are my assessments to the condominium association for my unit type and when are they due?
Answer: Each unit is liable for a proportionate share of the common expenses. Currently, there are seven (7) separate assessments that are based on the model type and square footage of each unit. The current monthly assessments are provided below:

Assessments are due on the first of each month. If assessments are not received by the tenth day of the month, an administrative fee of $25 per month is applied. Additionally, a 15% interest rate shall be applied to any unpaid balance. (See Article 19 of the Declaration of Condominium)
QUESTION: Do I have to be a member in any other association? If so, what is the name of the association and what are my voting rights in this association? Also, how much are my assessments?
Answer: Yes, Windsor Park Property Owners Association, Inc. Each unit owner holds one (1) vote for each condominium unit owned. Assessments are billed to each owner at a rate of $165.00 annually.
QUESTION: Am I required to pay rent or land use fees for recreational or other commonly used facilities? If so, how much and am I obligated to pay?
Answer: The Grand Reserve Condominium Association, Inc. requires rent to be paid for additional parking spots needed for vehicle and boat parking. The parking spots are located in specific locations through out the property at a rate of $15 per month. The Grand Reserve Condominium Association, Inc. requires each owner and tenants of owners that wish to use the amenities to purchase an amenities card to allow access to the Fitness Room and Pool Area. Amenity cards are purchased at the clubhouse with proof of ownership or an approved lease addendum for $25.00 each.
QUESTION: Is The Grand Reserve Condominium Association, Inc. or other mandatory membership association named as a party in pending litigation whereby damages are greater than $100,000?
Answer: The Grand Reserve Condominium Association, Inc. is named as a co-defendant in a lawsuit alleging lack of disclosure of construction defects. A dollar amount is not named in the initial filing.
Additionally, The Grand Reserve Condominium Association, Inc. is a Plaintiff in litigation against the original builder, the condominium developer, and additional parties. To date, no counter-claims have been asserted against The Grand Reserve Condominium Association, Inc. in this litigation. See www.coj.net  type in Case No: 16-2006-CA-003908
